In this paper we continue the study of the theories IΔ n+1 (T), initiated in [7]. We focus on the quantifier complexity of these fragments and theirs (non)finite axiomatization. A characterization is obtained for the class of theories such that IΔ n+1 (T) is Π n+2 –axiomatizable. In particular, IΔ n+1 (IΔ n+1 ) gives an axiomatization of Th Π n+2 (IΔ n+1 ) and is not finitely axiomatizable. This fact relates the fragment IΔ n+1 (IΔ n+1 ) to induction (...) rule for Δ n+1 –formulas. Our arguments, involving a construction due to R. Kaye (see [9]), provide proofs of Parsons’ conservativeness theorem (see [16]) and (a weak version) of a result of L.D. Beklemishev on unnested applications of induction rules for Π n+2 and Δ n+1 formulas (see [2]). (shrink)

The umbrella-term ‘executive functions’ includes various domain-general, goal-directed cognitive abilities responsible for behavioral self-regulation. The influential unity and diversity model of EF posits the existence of three correlated yet separable executive domains: inhibition, shifting and updating. These domains may be influenced by factors such as socioeconomic status and culture, possibly due to the way EF tasks are devised and to biased choice of stimuli, focusing on first-world testees. Here, we propose a FREE test battery that includes two open-access tasks for (...) each of the three abovementioned executive domains to allow latent variables to be obtained. The tasks were selected from those that have been shown to be representative of each domain, that are not copyrighted and do not require special hardware/software to be administered. These tasks were adapted for use in populations with varying SES/schooling levels by simplifying tasks/instructions and using easily recognized stimuli such as pictures. Items are answered verbally and tasks are self-paced to minimize interference from individual differences in psychomotor and perceptual speed, to better isolate executive from other cognitive abilities. We tested these tasks on 146 early adolescents of both sexes and varying SES, because this is the age group in which the executive domains of interest become distinguishable and in order to confirm that SES effects were minimized. Performance was determined by Rate Correct Scores, which consider speed-accuracy trade-offs. Scores were sensitive to the expected improvement in performance with age and rarely/inconsistently affected by sex and SES, as expected, with no floor or ceiling effects, or skewed distribution, thus suggesting their adequacy for diverse populations in these respects. Using structural equation modeling, evidence based on internal structure was obtained by replicating the three correlated-factor solution proposed by the authors of the model. We conclude that the FREE test battery, which is open access and described in detail, holds promise as a tool for research that can be adapted for a wide range of populations, as well as altered and/or complemented in coming studies. In most U.S. jurisdictions, clinicians providing informal “curbside” consults are protected from medical malpractice liability due to the absence of a doctor-patient relationship. A recent Minnesota Supreme Court case, Warren v. Dinter, offers the opportunity to reassess whether the majority rule is truly serving the best interests of patients.

Extending the growing literature on the role of grit in different life domains, this research explores the relationship between grit and involvement in entrepreneurship. The research highlights the role of personal income and satisfaction with one’s current financial situation as moderators of the relationship between grit and entrepreneurial behavior. Using a large representative sample of Spanish young adults and controlling for a number of potential confounding variables, we find that grit is modestly negatively related to the probability of involvement in (...) entrepreneurship. As predicted, however, this relationship is qualified by both income and satisfaction with current financial situation, though in opposite directions and more weakly for satisfaction with financial status. Gritty individuals with higher levels of income are more prone to become entrepreneurs than gritty individuals with lower levels of income. Gritty individuals with lower levels of satisfaction with their financial situation are more likely to set up a business or become self-employed. (shrink)

The acquisition and evolution of speech production, discourse and communication can be negatively impacted by brain malformations. We describe, for the first time, a case of developmental dynamic dysphasia (DDD) in a right-handed adolescent boy (subject D) with cortical malformations involving language-eloquent regions (inferior frontal gyrus) in both the left and the right hemispheres. Language evaluation revealed a markedly reduced verbal output affecting phonemic and semantic fluency, phrase and sentence generation and verbal communication in everyday life. Auditory comprehension, repetition, naming, (...) reading and spelling were relatively preserved, but executive function was impaired. Multimodal neuroimaging showed a malformed cerebral cortex with atypical configuration and placement of white matter tracts bilaterally and abnormal callosal fibers. Dichotic listening showed right hemisphere dominance for language and functional magnetic resonance imaging (fMRI) additionally revealed dissociated hemispheric language representation with right frontal activation for phonology and bilateral dominance for semantic processing. Moreover, subject D also had congenital mirror movements (CMM), defined as involuntary movements of one side of the body that mirror intentional movements of the other side. Transcranial magnetic stimulation and fMRI during voluntary unimanual (left and right) hand movements showed bilateral motor cortex recruitment and tractography revealed a lack of decussation of bilateral corticospinal tracts. Genetic testing aimed to detect mutations that disrupt the development of commissural tracts correlating with CMM (e.g., Germline DCC mutations) was negative. Overall, our findings suggest that DDD in subject D resulted from the underdevelopment of the left inferior frontal gyrus with limited capacity for plastic reorganization by its homologous counterpart in the right hemisphere. Corpus callosum anomalies probably contributed to hinder interhemispheric connectivity necessary to compensate language and communication deficits after left frontal involvement. (shrink)

In this work we define, in a general way, an algebraic semantics for the logics of the hierarchy InPk. This semantics is defined by means of an alternative construction, with respect to the usual algebraic semantics, and it is known in the literature as Twist-structures semantics. Besides that, we modify such construction, defining the so-called ω-Twist-structures here. This adaptation allows us to prove adequacy theorems for every logic of the hierarchy InPk.

The feeling of error (FOE) is the subjective experience that something went wrong during a reasoning or calculation task. The main goal of the present study was to assess the accuracy of the FOE in the context of mental mathematical calculation. We used the number bisection task (NBT) to evoke this metacognitive feeling and assessed it by asking participants if they felt they have committed an error after solving the task. In the NBT participants have to determine whether the number (...) presented in the middle of a triplet corresponds to the arithmetic mean of the two outer numbers (e.g., 07_16_25) with a Yes/No answer. Our results show that FOE reports were strongly correlated with arithmetic errors and numerical properties of the NBT, suggesting that the FOE accurately represents the error. This finding indicates that even very fast metacognitive feelings are reliable when it comes to evaluating one’s own mental performance. Moreover, our results suggest that the occurrence of FOEs is determined by the fluency with which each triplet was solved and the post-decision evaluation processes that occurred after the NBT was solved. Additionally, we asked participants to report their confidence in the given answer for the cases where they did not report FOEs. Participants reported less confidence for the (objectively) incorrect answers than for the (objectively) correct ones, suggesting that in cases where they did not have a conscious FOE they still were able to implicitly detect their errors. Remarkably, confidence was also determined by the fluency of the NBT. (shrink)

Alternative splicing (AS) is a widespread mechanism with an important role in increasing transcriptome and proteome diversity by generating multiple different products from the same gene. Evolutionary studies of AS have focused primarily on the conservation of alternatively spliced sequences or of the AS pattern of those sequences itself. Less is known about the evolution of the regulation of AS, but several studies, working from different perspectives, have recently made significant progress. Here, we categorize the different levels of AS evolution, (...) and summarize the studies on evolution of AS regulation, which point to a high level of evolutionary conservation of the regulation of AS events conserved between related species. This suggests that the quantitative regulation of AS is an intrinsic part of AS function. We discuss the potential role of changes in developmental regulation of AS as an additional layer in complex gene regulatory networks and in the emergence of genetic novelties. (shrink)

This essay explores some concerns about the quality of informed consent in patients whose autonomy is diminished by fatal illness. It argues that patients with diminished autonomy cannot give free and voluntary consent, and that recruitment of such patients as subjects in human experimentation exploits their vulnerability in a morally objectionable way. Two options are given to overcome this objection: (i) recruit only those patients who desire to contribute to medical knowledge, rather than gain access to experimental treatment, or (ii) (...) provide prospective subjects the choice to participate in standard doubleblind study or receive the experimental treatment. Either option would guarantee that patients in desperate conditions are given a more meaningful choice and a richer freedom, and thus a higher quality of informed consent, than under standard randomized trials. Society Semantics, introduced by W. Carnielli and M. Lima-Marques, is a method for obtaining new logics from the combination of agents of a given logic. The goal of this paper is to present several generalizations of this method, as well as to show some applications to many-valued logics. After a reformulation of Society Semantics in a wider setting, we develop in detail two examples of application of the new formalism, characterizing a hierarchy of paraconsistent logics called Pn and a hierarchy (...) of paracomplete logics In. We also propose three further generalizations, obtaining Society Semantics for several many-valued logics, including a hierarchy of logics called In Pk which are both paraconsistent and paracomplete. The aim of the present study was to assess the impact of past traumatic war experiences on preadolescents in the Gaza Strip, which could be useful for psychological intervention with current and future child victims. Participants were 521 preadolescents from United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) schools, aged 11 and 13 years old. Sections I to IV from Iraqi Version-Arabic of Harvard Trauma Questionnaire was used to assess trauma experiences and Post-Traumatic Stress (...) Disorder (PTSD). The results show that the preadolescents in the Gaza Strip witnessed the destruction of their homes and the murder of family members and friends. A quarter of the individuals assessed either suffered torture or witnessed others undergoing it, including sexual assaults. Almost half of them experienced a lack of food and clean water. The traumatic and torture experiences seriously affected preadolescents’ mental health as 26.29% met criteria for the diagnosis of PTSD. The data analysis revealed two PTSD modalities, with the severity of impact depending on whether social implications were involved. Further research is required to check whether these two modalities fit to PTSD and complex PTSD. Understanding the effects of past wars on preadolescents in Gaza and distinguishing between different PTSD types could enhance comprehension of the impacts of current attacks on child victims. It can also aid in determining the type of intervention needed to minimize the impact on the mental health of Palestinian youth, enhancing their resilience through psychological and social support. ObjectiveTo investigate the association of pre-existing migraine in patients hospitalised and who recovered from severe acute respiratory syndrome coronavirus 2 infection with the presence of post-coronavirus disease symptoms.BackgroundNo study has investigated the role of migraine as a risk factor for development of post-COVID symptoms.MethodsA case-control study including individuals hospitalised during the first wave of the pandemic was conducted. Patients with confirmed previous diagnosis of migraine were considered cases. Two age- and sex-matched individuals without a history of headache per case were (...) also recruited as controls. Hospitalisation/clinical data were collected from hospital medical records. Patients were scheduled for a telephone interview. A list of post-COVID symptoms was systematically evaluated, but participants were invited to freely report any symptom. The Hospital Anxiety and Depression Scale and the Pittsburgh Sleep Quality Index were used to assess anxiety/depressive symptoms and sleep quality. Multivariable conditional logistic regression models were constructed.ResultsOverall, 57 patients with confirmed diagnosis of migraine and 144 non-migraine controls who had recovered from COVID-19 were assessed at 7.3 months after hospital discharge. The number of post-COVID symptoms in the migraine group was significantly greater than in the non-migraine group. Fatigue was significantly more prevalent in the migraine group. However, no between-groups difference in the prevalence of headache as a post-COVID symptom was detected.ConclusionPatients with a history of migraine who recovered from COVID-19 exhibited more long-term fatigue as post-COVID sequelae than those without migraine. Some of the pathophysiological changes associated with migraine could predispose to the occurrence of post-COVID symptoms. (shrink)

The objective of this study is to analyze the role that peer support plays in the incidence relationships between sociometric popularity and general self-concept based on sociometer theory. A total of 676 randomly selected secondary school students from the Basque Country between 12 and 18 years of age participated voluntarily. All of them completed a sociometric questionnaire, the Family and Friends Support Questionnaire, and the Dimensional Self-concept Questionnaire. Several models of structural equations were tested. The results indicate that sociometric popularity (...) is linked to self-concept through the perceived social support of peers. These results are discussed within the framework of positive psychology and its practical implications in the school context. (shrink)

For a theory T, we study relationships among IΔ n +1 (T), LΔ n+1 (T) and B * Δ n+1 (T). These theories are obtained restricting the schemes of induction, minimization and (a version of) collection to Δ n+1 (T) formulas. We obtain conditions on T (T is an extension of B * Δ n+1 (T) or Δ n+1 (T) is closed (in T) under bounded quantification) under which IΔ n+1 (T) and LΔ n+1 (T) are equivalent. These conditions depend (...) on Th Πn +2 (T), the Π n+2 –consequences of T. The first condition is connected with descriptions of Th Πn +2 (T) as IΣ n plus a class of nondecreasing total Π n –functions, and the second one is related with the equivalence between Δ n+1 (T)–formulas and bounded formulas (of a language extending the language of Arithmetic). This last property is closely tied to a general version of a well known theorem of R. Parikh. Using what we call Π n –envelopes we give uniform descriptions of the previous classes of nondecreasing total Π n –functions. Π n –envelopes are a generalization of envelopes (see [10]) and are closely related to indicators (see [12]). Finally, we study the hierarchy of theories IΔ n+1 (IΣ m ), m≥n, and prove a hierarchy theorem. (shrink)

The scientific literature highlights the risk of the appearance of internalizing and externalizing symptoms, together with difficulties in the academic area, linked to diagnosis of Attention Deficit Hyperactivity Disorder. This is normally assessed by teachers and primary caregivers, disregarding the self-perception of the adolescents themselves, which limits detection of this disorder at an evolutionary stage. Our aim was to analyze the psychometric properties of a self-report for ADHD in adolescence and its relationship with psychopathology and academic performance. This study assessed (...) an incidental sample of 267 students from secondary schools in the Region of Murcia, Spain, using the EDAH questionnaire adapted for self-report, in order to analyze its psychometric properties in assessing ADHD. The Youth Self-Report and the Brief Self-Control Scale were also used to determine their association with psychopathological, self-control and academic performance variables. An ADHD prevalence of between 3.7 and 13.1% was observed depending on the established cut-off point. The adapted EDAH showed adequate reliability indices and explained a high variance percentage. Adolescents with anxiety/depression difficulties, dissocial behavior, aggressiveness, and poor performance in mathematics showed a higher amount of ADHD symptoms. Moreover, self-control, dissocial behavior, age, and performance in Social Sciences acted as predictors of the disorder. The good psychometric properties of this questionnaire and its adequate correspondence with other variables of interest suggest it is an appropriate self-report instrument to assess ADHD in adolescence. La nueva cultura del agua ha evidenciado que ésta y sus usos es algo mucho más complejo que el simple concepto de recursos hídricos, además de constituir una dimensión esencial de la sostenibilidad. En los ecosistemas áridos, la excesiva presión sobre el agua y sus impactos en los sistemas naturales amenazan la sostenibilidad global en tales zonas. Reconducir dicha situación, exige replantear el concepto de recursos hídricos y el de demandas, pasando de la tradicional categorización entre usos urbanos, agrarios, industriales (...) y turísticos, a una nueva categorización basada en las funciones del agua que diferencia tres niveles de prioridad: 1) agua-vida; 2) agua-interés general y 3) agua-negocio. A new variety of hemi-implicative lattices, here named sub-Hilbert lattices, containing both the variety generated by the \(\{\wedge,\vee,\rightarrow,1\}\) -reducts of subresiduated lattices and that of Hilbert lattices as proper subvarieties is defined. It is shown that any sub-Hilbert lattice is determined (up to isomorphism) by (...) a triple (_L_, _D_, _S_) which satisfies the following conditions: _L_ is a bounded distributive lattice, _D_ is a sublattice of _L_ containing 0, 1 such that for each \(a, b \in L\) there is an element \(c \in D\) with the property that for all \(d \in D\), \(a \wedge d \le b\) if and only if \(d \le c\) (we write \(a \rightarrow _D b\) for the element _c_), and _S_ is a non void subset of _L_ such that _S_ is closed under \(\rightarrow _D\) and _S_, with its inherited order, is itself a lattice. We study the theories I∇n, L∇n and overspill principles for ∇n formulas. We show that IEn ⇒ L∇n ⇒ I∇n, but we do not know if I∇n L∇n. We introduce a new scheme, the growth scheme Crγ, and we prove that L∇n ⇒ Cr∇n⇒ I∇n. Also, we analyse the utility of bounded collection axioms for the study of the above theories.

El cruce entre dos tradiciones intelectuales sin una clara trayectoria común es el punto de partida de los artículos que componen el presente volumen. Este aborda el complejo diálogo del marxismo -en su doble faz de teoría crítica y práctica- y la hermenéutica, la disciplina centrada en la interpretación. El libro está articulado en dos partes. Ha participado en los proyectos de investigación "El problema de la interpretación literaria" (2010-2011) y "Actualidad de la hermenéutica" (2014-2018) en el marco de los cuales ha publicado algunos artículos sobre hermenéutica literaria e historiografía y sobre los vínculos entre los géneros novela e historia. Actualmente es profesora de Lengua española en la Universidad de Bolonia (Italia).Antonio Gómez L-Quiñones se doctoró en las universidades de Granada (2003) y Colorado (2005), y realizó posteriormente estudios de postdoctorales en la Escuela de Crítica y Teoría (Cornell University) y en la European Graduate School (Suiza). Primer, sobre Raval s�haurien dut a terme tot tipus d�abusos, com destruccions d�habitatges i de trama urbana, així com persecucions o expulsions de població, pel bé del barri o de la ciutat. Si això és així, es pot afirmar que les convergències institucionals en aquest punt es sustenten en una epistemologia interessada. Segon, el (...) pathos de la distància definit per Nietzsche, així com l�assumpció per part de les noves ideologies urbanístiques del primitiu paper de la �casta sacerdotal�, permetrien actualitzar la crítica envers �el civisme�, entès aquest, com l�expressió més recent i efectiva de les cultures de control. I tercer, aquesta epistemologia interessada, permetria reclamar la noció marxiana de lluita de classes per interpretar un crònic i generalitzat menyspreu sobre una part important de la població més irredempta d�un dels barris més convulsos d�Europa. Le Corpus oral et sonore de l’espagnol rural(COSER) est un corpus d’enquêtes orales qui a pour but l’étude de la grammaire dialectale dans la péninsule ibérique. Dans cet article, les caractéristiques du COSER et la méthodologie suivie sont décrites et comparées à celles des atlas pour ce qui concerne la recherche sur la grammaire dialectale. Grâce au COSER, de nombreux aspects syntaxiques peu connus ou totalement ignorés des dialectes espagnols ont pu être étudiés, tels que plusieurs paradigmes pronominaux, la substitution (...) du subjonctif et l’accord neutre de matière. De plus, la répartition géographique de ces aspects a parfois été considérablement élargie, et les explications traditionnelles ont été remplacées par de nouvelles, en se basant sur une meilleure connaissance des données. L’étude de la grammaire dialectale s’avère être une importante source d’information favorisant une meilleure compréhension des nombreux croisements des principes linguistiques, comme l’« Agreement Hierarchy », par exemple, et ouvrant la voie à de nouvelles approches permettant de tester leur validité. The principles of such abandonment are habitual and active thinking. That Theory of knowledge justifies the fact that we really know that the act (esse) is the fundamental of being (ens) and the judgements and discourses spreading out from the transcendental notion of being.

Este artículo trata de analizar la célebre frase orteguiana “e_l hombre no tiene naturaleza, sino que tiene… historia_” dentro del contexto de su obra, mostrando su génesis y su evolución, así como las interpretaciones que se le han venido dando a la misma. Junto a este análisis, se mostrará también la importancia de esta idea dentro de la filosofía de Ortega, así como la relevancia que estas ideas podrían tener para una posible reforma de la metafísica tradicional.

El artículo ilustra la utilización del _case method_ a través de una investigación socio-educativa reciente donde se traza una analogía entre el caso de los exploradores de L. Fuller con la situación vital marcada por la pandemia. A tal efecto, pasa revista a cuestiones radicales que se desataron ante la urgencia de un problema cardinal de supervivencia y de salud pública que dejó todo lo demás (derecho, convenciones, moralidad, libertades) en la sombra y plantea algunos dilemas ético-jurídicos desencadenados bajo ciertas (...) situaciones consideradas de emergencia extrema donde la supervivencia de todos está en juego. Frente a la trampa hobbesiana de un supuesto estado de naturaleza por el cual es justificable cualquier tipo de ataque preventivo o violencia, en el artículo se trata de argumentar, al hilo de las respuestas dadas al caso jurídico de Fuller, nuevas formas de entender la comunidad, el pacto social, lo público y lo político. Our aim in this paper is to clarify the distinctions and the relationships among several phenomena, each of which has certain characteristics of what is generally called “deference”. We distinguish linguistic deference, which concerns the use of language and the meaning of the words we use, from epistemic deference, which concerns our reasons and evidence for making the claims we make. In our in-depth study of linguistic deference, we distinguish two subcategories: default deference, and deliberate deference. We also discuss the (...) phenomenon of im-perfect mastery, often associated with deference, and which we show to be independent both of linguistic deference and of epistemic deference. If our analysis is correct, then some recent debates on deference can be shown to result from a failure to appreciate all the distinctions that we draw here. (shrink)

La genealogia de la moral de Nietzsche, resulta extremadament pertinent per una epistemologia del bé relativa a les incisions institucionals sobre part de la població del Raval. Primer, sobre Raval s’haurien dut a terme tot tipus d’abusos, com destruccions d’habitatges i de trama urbana, així com persecucions o expulsions de població, pel bé del barri o de la ciutat. Si això és així, es pot afirmar que les convergències institucionals en aquest punt es sustenten en una epistemologia interessada. Segon, el (...) pathos de la distància definit per Nietzsche, així com l’assumpció per part de les noves ideologies urbanístiques del primitiu paper de la “casta sacerdotal”, permetrien actualitzar la crítica envers “el civisme”, entès aquest, com l’expressió més recent i efectiva de les cultures de control. I tercer, aquesta epistemologia interessada, permetria reclamar la noció marxiana de lluita de classes per interpretar un crònic i generalitzat menyspreu sobre una part important de la població més irredempta d’un dels barris més convulsos d’Europa. Desde la separación estricta de ética y derecho, la Rechtslehre kantiana sostiene que es la ética la que exige al sujeto que haga suya la máxima de actuar conforme al derecho. En la misma línea defiende J. F. Kervégan que los sujetos habríamos de reconocer como un deber ético el respeto a las normas jurídicas, sin que esto quiera decir que el derecho dependa de la ética, pues en estricto derecho no podría tenerse a la intención de conciencia como móvil (...) de la acción justa. Lo que el derecho regula y juzga son las acciones exteriores, y también el móvil tiene que es el poder coercitivo, que el derecho, a diferencia de la ética, tiene la facultad de imponer a la sociedad a fin de que cada miembro de ella en su acción externa evite por su propio interés perjudicar la libertad de cualquier otro. Por esta unicidad del móvil sostiene Kant que derecho y facultad de coaccionar significan una y la misma cosa. El formalismo de su planteamiento impide a Kant entrar en la complejidad del entramado de derechos y deberes, de bienes y cargas, que hace de la justicia distributiva el verdadero objeto del arte jurídico. Y por su externalización estricta del derecho reduce al jurista a la observancia de los textos, ignora el procedimiento de la controversia judicial, excluye la equidad como ajena al derecho, y convierte al derecho en el gendarme de la moral . En cuanto a la intención interior, una cosa es que las leyes no puedan motivar el albedrío por la conciencia de la obligación, y otra que si derecho y coacción significaran lo mismo no habría diferencia entre cumplir la ley para evitar el castigo o eludir el castigo burlando la ley -opción ésta que a muchos resultaría más provechosa, dado que el poder del Estado es incapaz de vigilar en cada momento a cada sujeto, y que los vigilantes mismos necesitan ser vigilados, ad infinitum. Tras una breve alusión a los conocidos argumentos de Platón, Hobbes y Montesquieu sobre la obediencia voluntaria como el otro móvil del derecho, no menos necesario que la coerción, se recuerda que también el profesor Kervégan ha defendido en otro contexto que un orden jurídico cualquiera tiene dos componentes irreductibles entre sí: el sistema de normas que define lo que debe ser y la decisión que conforma el ser al deber-ser. Finalmente, en el derecho interestatal no puede Kant invocar la facultad de coaccionar, que deja de significar lo mismo que "derecho" porque, al no haber ninguna fuerza superior a la soberanía de los Estados, el pacto durará hasta que alguno de ellos lo incumpla por su libre y soberana decisión. From a firm distinction between ethics and right, the Kantian Rechtslehre holds that the demand to adopt the maxim to act according to the right is an ethical demand. Also J.F. Kervégan defends that individuals should recognize the ethical obligation to respect juridical rules, but this does not mean that right depends on ethics, because, in strict right, internal disposition or intention could not be considered as motive for the rightful action. Law regulates and judges the external actions and also the motive has to be external as it is external the coercion that right -but not ethics- can impose on society so that each member of it, for his own interest, does not damage in his external agency any other member's freedom. Because of this only one motive, Kant declares that right and coercion's capacity signify the same thing. His formalist position stops him to go into the complex network of rights and duties, of advantages and burdens, which makes distributive justice the true subject of juridical art. Moreover, because of the strict externals of the law Kant is unaware of the juridical controversy, reduces the jurist to the observance of texts, ejects the equity as not right's own, and risks to transform the right in the gendarme of morals . With regard to intention, one thing is that in strict law the internal disposition can not be deemed as the motive, and other thing is that if law and coercion's capacity signify the same thing, there is no difference between obeing the law to avoide the punishment, or avoiding the punishment in breaking the law; then, the last option would be profitable for too many people, since the coercion power is not able to survey in every moment each individual, and the watchmen themselves need to be watched over and so on. After a short mention of the well known Plato, Hobbes and Montesquieu's arguments about the voluntary obedience as the other motive of the strict right, not less necessary than coercion, we remember that J. F. Kervégan also defended in another context that any juridical order has two irreducible le système des normes générales qui définissent ce qui doit être, et la décision qui conforme l'être au devoir-être. La 1. parte analiza el empobrecimiento moderno de la Erfahrung que genera una“nueva barbarie”, a la vez que expenmentación innovadora, y que reclama un concepto más rico de experiencia, ligada ala totalidad concrete de la existencia. La 2. señala algunas paradojas de la memoria, muestra la inconsistencia del tiempo, cristalizado en el mito de Cronos, comoprincipio ordenador, y toma en consideración experiencias relevantes (...) que requieren concebir otro tiempo. En esa dirección, la 3. parte desarrolla la idea de Jetztze¡t, nucleo de la concepción crítica de la historia como tradición de los oprimidos, en cuyos bistantes de peligro relanipagea el angelus novus.Il s’agit d’une reflexion interdisciplinaire sur les liaisons entre expérience, temps et bistoire. La lére partie analyse l’appauvrissement moderne de l’Erfahrung, qui produit, selon W.
